It is often true that a lawsuit may properly be brought in more than one state or jurisdiction, each having significant advantages and disadvantages. For example, if the employer of the other driver, or the owner of the other vehicle is a corporation, your lawsuit might properly be brought in the owner’s or the employer’s state of incorporation or principle place of business in addition to the state of the driver’s residence and the place the accident occurred. The choice of state in which to file suit can be critical, as in some states, for one example, if the plaintiff is one percent negligent he cannot recover a dime, whereas in other states, even if he is 99 percent negligent he can recover 100 percent of his medical and earnings damages and 1 percent of his pain and suffering. In some jurisdictions the jurys may be more favorable or more likely to award greater damages. Ask Joe Jamail what the most critical factor was in his obtaining the first billion dollar jury verdict. He dismissed his case previously filed in Delaware, giving up an important defendant who had been served there, and refiled the case in his preferred jurisdiction only to get the jury he felt would credit his case. While the choice of the jurisdiction in which to file your case may be the most important decision you will make, it is an issue upon which the client rarely receives unbiased advice.
